Special Education Needs

If your child has special education needs, the process of obtaining the needed supports and services from the public school system can be an overwhelming and exhausting experience.  The first step is generally getting the school system to consider the student for special education services and determine if the student is eligible for those services.   This often involves meeting with an Individualized Education Program (IEP) team to review assessments and evaluations that outline the student’s needs and to make recommendations regarding the student’s educational needs.  The information is then incorporated into a document called an Individualized Education Program (IEP), which describes a precise plan of action for teachers and other school personnel.

The Individuals with Disabilities Education Act (IDEA) is the federal law outlining the minimum legal requirements that a state’s public school system must follow with respect to providing children with disabilities a free and appropriate public education. (FAPE)  States also enact state law that works in conjunction with federal law and that may provide additional protections for that state’s citizens.  For example, the State of Maryland’s Education Law provides for “wrap around” services for families who need additional services outside of normal school day hours.
Our attorneys, in conjunction with additional educational experts, help parents ensure that student’s are properly considered for special education services, that IEP’s are developed in compliance with state and federal law and that the IEP is properly implemented so that our client’s children make meaningful educational progress.  We also work with you to secure and maintain the related services that your child needs and deserves.

Suspension and Explusion

We assist families and students with and without disabilities at the school level when faced with school disciplinary actions such as suspension and expulsion in addition to representing them in appeals to the various Boards of Education and the Maryland State Board of Education.

Understanding that the relationship of parents and students with their school district is ongoing and often involves siblings within the same district, our general approach is to preserve the relationship on good terms by attempting to seek an agreeable resolution to any disagreements through collaboration, expertise and negotiation.  However, we do not hesitate to propose and recommend any available legal remedies – including due process hearings and state or federal litigation – in the event that the parties involved are not cooperative. Our primary goal is protecting our clients’ rights and ensuring that children have access to the education they deserve.
